HighFear ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. This Digital Millennium Copyright Act (DMCA) Policy outlines the procedures for reporting copyright infringement on our website, highfear.com, and describes how we handle such reports in compliance with the DMCA (17 U.S.C. § 512).

Filing a DMCA Takedown Notice

If you believe that content hosted on HighFear infringes upon your copyright, you may submit a written notification to our Designated Copyright Agent. To be effective under the DMCA, your notification must include the following:

1. Identification of the copyrighted work — A description of the copyrighted work that you claim has been infringed. If multiple works are covered by a single notification, provide a representative list.
2. Identification of the infringing material — The specific URL(s) or a description of where the allegedly infringing material is located on our site, with enough detail for us to find it.
3. Your contact information — Your full legal name, mailing address, telephone number, and email address.
4. Good faith statement — A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
5. Accuracy statement — A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or are authorized to act on behalf of the owner.
6. Signature — Your physical or electronic signature (or the signature of a person authorized to act on behalf of the copyright owner).

Please note: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees.

Our Response to Valid Notices

Upon receipt of a valid DMCA takedown notice, we will:

• Remove or disable access to the allegedly infringing material promptly
• Notify the content provider, member, or user that the material has been removed
• Provide the content provider with a copy of the takedown notice (with personal information redacted where appropriate)
• Terminate the accounts of repeat infringers in appropriate circumstances

Filing a Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with our Designated Copyright Agent. Your counter-notification must include:

1. Your physical or electronic signature
2. Identification of the material that was removed and the location where it appeared before removal
3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
4. Your name, address, and telephone number
5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the United States, any judicial district in which HighFear may be found
6. A statement that you will accept service of process from the person who provided the original DMCA notification or an agent of such person

After a Counter-Notification

Upon receipt of a valid counter-notification, we will:

• Forward the counter-notification to the original complainant
• Inform the complainant that the removed material will be restored in 10-14 business days
• Restore the material within 10-14 business days unless we receive notice that the complainant has filed a court action seeking to restrain the content provider from engaging in infringing activity

Repeat Infringers

In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
